A woman with a disability who needed help boarding an airplane six years ago has been awarded Sh400,000 by a local low-cost airline for their negligence.
On April 29, 2016, at the Eldoret International Airport, Fly 540 failed to provide Agnes Mithamo Nyaga with the particular equipment she needed to board the aircraft. As a result, High Court judge Hedwig Ong’udi determined that Fly 540 had discriminated against Agnes Mithamo Nyaga.
According to the judgment, people with disabilities are entitled to the equipment and resources they need to live properly and comfortably in society, including information about how to get around.

Dr. Nyaga had filed a claim for damages against the airline, alleging that it had violated her fundamental freedoms and rights and caused her emotional suffering. The airline check-in employees would typically ask her if she needed assistance boarding the aircraft, she testified to the court.
Dr. Nyaga stated that despite her impairment making it challenging for her to climb stairs, she does occasionally board alone. She testified that she was provided with a wheelchair at the airport and wheeled to the aircraft, some of which had a chair lift or a forklift to allow her entrance. The pilot, however, was the one who stopped her from using the forklift during the incident.
